HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43669 of 2016 ORDER:
This writ petition is filed seeking to declare the issuance of FIR in Crime No.99 of 2016, dated 01.07.2016, as illegal and arbitrary and consequently to set aside the same. Heard and perused the material available on record. The case of the petitioner is that the petitioner is working as Sweeper, ERO Office, at Srikalahasthi and permanent resident of Door No.17-133, Panagal Srikalahasthi Town, Chittoor District. The 4th respondent lodged the present complaint against the petitioner, who is her mother-in-law, alleging that the petitioner is harassing the 4th respondent mentally by saying her to die since her son died. The main grievance of the petitioner is that the petitioner is looking after her daughter, who is physically handicapped and the children of her deceased son and that the 3rd respondent is threatening the petitioner to arrest based on the complaint lodged by the 4th respondent.
Considering the grievance of the petitioner and since the petitioner is a lady aged about 58 years, the 3rd respondent is directed to complete the investigation in Crime No.99 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
