HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.12519 of 2012 ORDER:

Heard Sri Palivela Satyaraja Babu for petitioner and Sri Sridhar Reddy for respondents 2 to 4. No representation for the 1st respondent-Gram Panchayat.

The petitioner has twin grievances against the 1st respondent. The first grievance is that the 1st respondent is not entering the name of petitioner in the Property Register maintained by the 1st respondent on the strength of Gift Settlement Deed dated 06-042009 and secondly issuing notice dated 10-12-2010 is illegal. I have perused the notice dated 10-12-2010.

This Court is of the view that the petitioner ought to be given time for filing explanation for at this stage of consideration the merits ought not to be gone into. The 1st respondent is directed to consider the allegations in the notice and explanation given by the petitioner as well as respondents 2 to 4 and take a comprehensive decision on the issue whether the petitioner is entitled for mutation or not.

Counsel for petitioner requests time to file explanation. The petitioner is given four weeks time from the date of receipt of a copy of this order to file explanation to the notice dated 10-12-2010 before the 1st respondent.

The 1st respondent calls upon the petitioner as well as respondents 2 to 4, affords opportunity and passes final orders on the request of petitioner for mutation and the show-cause notice dated 10-12-2010.

The said exercise shall be completed within eight weeks from the date of receipt of explanation from the petitioner. The writ petition is disposed of accordingly. There shall be no order as to costs.

Miscellaneous applications, if any pending, shall stand closed.
