THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35121 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 2 to 5 in not taking any investigation in crime No.814 of 2015 of P.S., Kukatpally, in accordance with law as illegal, arbitrary and violative of principles of natural justice and consequently to direct the respondents 2 to 5 to transfer the said crime to Central Crime Station, Cyberabad. Heard and perused the material.

Learned counsel for the petitioner submits that though the complaint given by the petitioner is registered, the respondents 2 to 5 are not conducting any investigation and as such, seeks to transfer the said case to the Central Crime Station, Cyberabad. Learned Assistant Government Pleader for Home (Telangana) submits that the investigation is in progress and the police will file the final report after completion of the investigation. Considering the facts and circumstances of the case, the respondents 2 to 5 are directed to conduct effective investigation and file final report, if any, in accordance with law. It is made clear if the respondents 2 to 5 are of the view that the case may be investigated by the Central Crime Station, Cyberabad, they are at liberty to transfer the same to the Central Crime Station, Cyberabad.
