HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.1767 of 2015 in Crl.P.No.1637 of 2015 and Criminal Petition No.1637 of 2015 COMMON ORDER:

Defacto complainant and her counsel Sri Akkam Eshwar are present. Accused and his counsel Sri K.E.Hari Prasad are present.

On the report given by defacto complainant the police of K.P.H.B. colony PS registered FIR No.86 of 2014 against the accused for the offences under Sections 354, 506 and 509 IPC and the investigation is reported to be pending. The allegation is that the accused who is residing in the same colony of complainant used to misbehave with her and on 28.01.2015 he went to the complainant's house and misbehaved with her in the presence of her mother and children. While so, both the parties and their counsel appeared in the Court and submitted that at the intervention of elders they have amicably resolved their differences and they want to lead peaceful and harmonious life and there is no threat to the complainant from the accused and the complainant has no objection for quashment of proceedings and therefore, permission may be accorded to them to compound the offence and proceedings may be quashed accordingly in the interest of justice.

Having regard to the above submission and considering

the fact that at the intervention of elders they have settled their disputes and now they are leading peaceful and harmonious life and there is no threat to the complainant from the accused and no useful purpose will be served if they are driven to trial, and following the decision reported in Gian Singh v. State of Punjab and another[1] this petition is allowed and permission is accorded to the parties to compound the offence and compromise is recorded and proceedings in FIR No.86 of 2014 of KPHB Colony PS are hereby quashed.

In the result, both the petitions are accordingly allowed.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
