HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.17069 of 2017 ORDER:

This writ petition is filed to declare the action of the 4th respondent in passing order vide proceedings bearing No.B/970/2016, dated 22-02-2017 and the consequential proceedings bearing No.A/970/2016, dated 09-05-2017 directing restoration of land in an extent of Ac.2-92 cents in Sy.No.282/2 of Santhakovvuru Village, Thondur Mandal, YSR District in favour of the 5th respondent, which is in exclusive possession of the petitioner, as illegal and arbitrary.

Learned counsel for the petitioner submits that pending writ petition, the petitioner has filed appeal on 19-05-2017 against the impugned order dated 22-02-2017 along with stay petition before the 3rd respondent. But no orders are passed on the same. Since the petitioner has availed alternative remedy of appeal against the impugned order, I am not inclined to entertain the writ petition. However, the 3rd respondent is directed to dispose of the stay petition/appeal within a period of four weeks from the date of receipt of a copy of this order. Till then, there shall be stay of dispossession of the petitioner from the subject land.

Accordingly, this writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
