THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.33839 OF 2016 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to direct respondent No.2 to cause enquiry with regard to the interference of respondent Nos.4 and 5 in respect of the peaceful possession and enjoyment of the petitioner's property to an extent of Ac.4.76 cents in Sy.No.217/3 situated at Gudiwada Revenue Village, S.Rayavaram Mandal, Visakhapatnam District and in calling the petitioner regularly to the police station and pressurising her to settle the land disputes with respondent No.6 and declare the same as illegal and arbitrary and consequently, to direct respondent Nos.4 and 5 not to interfere with the peaceful possession and enjoyment of the petitioner's property, not to call her to the police station and not to pressurise her to settle the land disputes with respondent No.6.

Heard and perused the material available on record. 3.

Learned Assistant Government Pleader for Home denied the entire allegations and submitted before this Court that the petitioner was never called to the police station by respondent Nos.4 and 5 and they will not interfere in any of the civil disputes pending before the petitioner and respondent No.6. 4.

Considering the rival contentions of both parties, this Court is of the view that the writ petition can be disposed of with the following direction:

Respondent Nos.4 and 5 are hereby directed not to interfere in any of the civil disputes pending before the petitioner and respondent No.6. At the same time, the present order will not stand in the way of respondent Nos.4 and to proceed with the investigation, if any complaint is registered against the petitioner for a cognizable offence.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
