THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9848 OF 2016 ORDER:

This Writ Petition is filed for a Mandamus declaring the inaction of the 3rd respondent in considering the petitioner's request for issuance of legal heir certificate/family members certificate to her, as illegal and arbitrary and consequently to direct the respondents to issue legal heir certificate/family members certificate to the petitioner by mentioning her name as Smt B.Uma Maheswari @ Mahitha.

Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents..

3. Learned Assistant Government Pleader submits that there are discrepancies as regards the name of the petitioner in the documents submitted by her to the Mandal Revenue Officer and the purpose for which the application is filed is for getting the death benefits of her husband.

4. No provision of law is cited before this Court empowering the Tahsildar to issue any legal heir certificate or succession certificate or Family members certificate. In view of the same this Court cannot give any direction to the 3rd respondent to issue legal heir certificate/family members certificate. It is for the petitioner to approach concerned authority or Civil Court for obtaining the same. Therefore, I do not find any merits in this Writ Petition.

5. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

6. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
