THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34733 of 2018 ORDER:

When the matter is taken up, written instructions dated 25.09.2018 furnished by the Sub-Inspector of Police, Balanagar Police Station, Hyderabad are placed on record by the learned Government Pleader for Home.

To the extent of their relevance to the present writ petition, the said instructions read as under:

"It is respectfully submitted that as per the records, the facts of the case are as follows:

On receipt of a private complaint filed by the petitioner herein from the Hon'ble Court of XXIV Metropolitan Magistrate, Cyberabad at Kukatpally, a case in Cr.No.330/2017 U/secs.447, 427, 323, 506, 457, 380 r/w 120-B IPC and r/w Sec.156 (3) Cr.P.C dt.10.8.2017 was registered on the file of Balanagar Police Station against 1) Smt.Salma Begum, 2) Nayeema, 3) Essamiya Babu and 4)Badar Sultana and taken up the investigation into the case. During the course of investigation, the investigation officer examined as many as 5 witnesses including the complainant/petitioner and recorded their detailed statements.

As per statements of the witnesses, there is no evidence with regard to trespass, damage to the property, assault, criminal intimidation and theft of silver and gold ornaments by the alleged accused.

Full fledged investigation was completed. Proposals were also submitted before the Assistant Commissioner of Police, Balanagar Division to refer the private complaint of the petitioner/complainant herein as "False"

and accorded permission.

After following the due procedure ie., serving of notice to the complainant, final report will be filed into the concerned Hon'ble Court within a week."

On noticing the above instructions, a request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.

Accordingly, the writ petition is disposed of by placing on record the written instructions dated 25.09.2018 furnished by the Sub-Inspector of Police, Balanagar Police Station, Hyderabad. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
