HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL REVISION CASE No.2451 of 2014 ORDER:
The present Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C., aggrieved by the order dated 27.11.2014 passed in Crl.A.No.1018 of 2014 on the file of Special Judge for Trial of Offences under SCs/STs (POA) Act-cum- VI Additional Metropolitan Sessions Judge, Secunderabad, wherein and whereunder the request of the petitioner for custody of M.Varalakshmi @ Renuka, was rejected.
The facts in issue are as under:
Originally an application under Section 17-A of the Immoral Traffic (Prevention) Act was filed seeking release of the victim woman by name M.Varalakshmi, in favour of the petitioner who is her daughter. A perusal of the material before the Court would disclose that a case in Cr.No. 314 of 2014 of Bowenpally Police Station came to be registered against the accused under Prevention of Immoral Trafficking Act, 1956. The mother of the petitioner was the victim in the case. The gist of the allegations reveal that the victim was found with two customers along with another woman in the premises pursuant to the raid conducted by the Inspector of Police, Bowenpally and an amount of Rs.18,000/- was seized from the accused therein. The daughter of victim filed Crl.M.P.No.1260 of 2014 seeking release of her mother on the ground that the victim, who was working as a maid servant was victimised in the case. Having regard to the circumstances of the case and as the said victim needs care, protection and counselling, she was sent to Prajwala Home, Protective Home for
a period of six months from the date of initial admission i.e. 27-072014. On that the petitioner filed an Appeal which was also dismissed. Aggrieved by the same, the present Revision is filed. On 31-12-2014 this Court while issuing notice to the respondent, directed the authorities of Prajwala Rescue Home at Charminar, Hyderabad to send a report after examining the victim Varalaxmi. On 19-01-2014, this Court received a report sent by the Senior Project Coordinator, Prajwala Rescue Home enclosing a copy of the statement of the victim. A perusal of the report and the statement of victim reveal that the victim wants to finish her course, which would be completed on 27-01-2015, and then leave the home along with her daughter.
In view of the report of Senior Project Coordinator of Prajwala Home and the statement of the victim woman, the Revision is allowed and the victim by name M.Varalakshmi @ Renuka be permitted to leave the Prajwala Rescue Home along with her daughter. It is also made clear that the said victim shall furnish her address and also place of stay after her release from said Rescue Home. It is needless to mention that she shall co-operate with the investigating agency and make available herself to the Investigating agency as and when required by them.
Miscellaneous petitions, if any, pending in this Criminal Revision Case shall stands closed.
