THE HON'BLE SRI JUSTICE M.S.K.JAISWAL Civil Revision Petition No. 4296 of 2017 ORDER:

The revision petition is filed against the Order of the Principal District Judge, Srikakulam in TOP.No.402 of 2016, dated 09.03.2017, by and under which the learned District Judge has refused to transfer the RCC.No.1 of 2014 from the file of Rent Controller-Cum-Junior Civil Judge, Tekkali to any other Court in Srikakulam district.

The petitioner filed the above transfer petition contending that whenever he was appearing in the Court below in connection with the above RCC, the respondent, who is a local person with sufficient influence and power, is threatening him and since there is a threat to his life, he sought for transfer of the RCC from Tekkali to any other Court in Srikakulam district. 3.

The learned District Judge, after considering the entire material on record and for valid reasons, held that there is no such threat and the apprehension of the petitioner is misconceived. Therefore, for the reasons mentioned in the order, the learned District Judge, refused to transfer the RCC from Tekkali to any other Court in Srikakulam district. The said impugned order does not suffer from any illegality or irregularity, warranting interference in the present revision. Hence, there are no merits in the revision, which is liable to be dismissed.

Accordingly, the revision petition is dismissed. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
