Heard Sri M.Koteswara Rao for petitioner and the learned Assistant Government Pleader for Revenue.

The petitioner claims to be the owner and possessor of an extent of Ac .0-70 cents in Sy.No.898/ 3 of Piduguralla Village and Mandal, Guntur District.

Now the grievance is that the 4th respondent without recourse to law is interfering with the possession and enjoyment of petitioner of subjec t matter of the writ petition. The Assistant Government Pleader places on record written instructions of even date and contends that the respondents do admit that the land in an extent of Ac.0-70 cents in Sy.No.898/ 3 of Piduguralla Village is private patta land. The 4th respondent or his subordinates are not interfering with the possession and enjoyment of an extent of Ac .0-70 cents in Sy.No.898/ 3 of Piduguralla Village. The further explanation offered is that the land in Sy.No.896/ 6-1C is Government land and the respondents are taking steps to protect only Government land. The statement is placed on record.

The writ petition is disposed of with a direction that the respondents, as stated, will not interfere with the possession and

enjoyment of petitioner of an extent of Ac .0-70 cents in Sy.No.898/ 3 of Piduguralla Village and Mandal, Guntur District. It is made clear that the land in Sy.No.898/ 6-1C, which is not claimed by the petitioner, c an be protec ted from encroachment or take steps to dispossess unauthorized occupants.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
