Petitioner has filed this Writ Petition alleging that he had preferred an appeal on 13.12.2016 to the 1st respondent challenging the order dt.11.02.2016 passed by the 2nd respondent under F.R.54(4) and F.R.54(B)(7) treating the period between 24.03.2004, when the petitioner was dismissed from service, to the actual date of retirement on 30.04.2008 as not on duty, without providing him any opportunity even though the petitioner has been acquitted in Crl.R.C.No.1984 of 2004 on 17.02.2012 by the High Court and the 1st respondent has not disposed of the said appeal till date.

The Government Pleader for Services appearing for respondents states that the 1st respondent will consider the petitioner's appeal and pass orders within a period of eight
(08) weeks from the date of receipt of a copy of this order and communicate the same to the petitioner.

In view of the said submission, this Writ Petition is disposed of directing the 1st respondent to consider and pass orders on the petitioner's appeal preferred on 13.12.2016 within a period of eight (08) weeks from the date of receipt of a copy of this order and communicate the same to the petitioner. There shall be no order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
