THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 43141 of 2016 ORDER:

This writ petition is filed challenging the action of respondent No.5 in seizing the premises situated at Pedda Amberpet Village, Hayathnagar Mandal, Ranga Reddy District under seizure reports, dated 16.09.2016 and 17.09.2016, pursuant to registration of Crime No.193 of 2016 against respondent No.6 for the offences punishable under Sections 406, 420 and 506 I.P.C.

A reading of the Remand Case Diary shows that Accused Nos.1 to 11 placed an advertisement in the news papers for business proposal in the name of Eider Motors Limited and lured about 80 members as dealers and made them to lose about 20 crores. It appears that certain motor vehicles are placed in the premises owned by the petitioners. The said premises was seized and there is a list of vehicles lying in the factory premises. There is no dispute that the petitioners are owners of the said premises and the accused are only lessees. The petitioners state that respondent No.6, who is an accused, is willing to shift the vehicles to a safer place provided respondent No.5 gives consent for the same. Today, on the basis of instructions, learned Government Pleader for Home, submits that respondent No.5 has no objection for shifting the seized vehicles which are located in the premises of the

petitioners to a safer place by respondent No.6 under intimation to respondent No.5.

In view of the above, it is open to the petitioners to prevail upon respondent No.6 to shift the vehicles to a safer place after intimation to respondent Nos.3 to 5. Respondent Nos.3 to 5 agreed to extend their cooperation as and when such intimation is given to them. In view of the same, no further orders are necessary in the present writ petition, except giving liberty to the petitioners and respondent No.6 to shift the vehicles to a safer place after intimation to respondent Nos.3 to 5 and on such shifting, the seizure of the premises shall be withdrawn.

The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:10.04.2017 kdl
