THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34465 of 2018 ORDER:
When the matter is taken up, written instructions dated 26.09.2018 furnished by Sub-Inspector Police, Chandrugonda Police Station are placed on record by the learned Government Pleader for Home.
To the extent of their relevance to the present writ petition, the said instructions read as under:
"The petitioner herein has approached the police of Chandrugonda Police Station, Bhadradri Kothagudem District and lodged a complaint on 22.07.2016 at 2000 hrs stating that Sri Kondarapu Naresh, (Reg.No.413389) s/o Narayana, H.No.1-3/1 Ganugapadu (v & P), Chandrugonda mandal, Khammam dist has participated in the SCt PCs recruitment - 2011 and provisionally selected to the post of SCt PC (APSP) 8th Bn. During the SB verification of certificates and antecendents of the said candidate it was found that the caste certificates submitted by him was found fake. The matter was got enquired as per the reports submitted by the SHO, Chandrugonda P.S., the Tahsildar, Chandrugonda and the SB DSP Khammam remarks were submitted to the Chairman Telangana State Level Police Recruitment Board, Hyderabad.
The Chairman, TSLPRB, Hyderabad has passed instructions to take action as per law in order to elicit truth behind the fake certificate SSID:2225-0000-1016-4703, Appl.No.2008430, Dt.30.07.2007 obtained by the accused Kondarapu Naresh vide Reg.No.413389 who was provisionally selected for SCT PC (APSP) in 8th Bn. During the recruitment-2011 at the time of documents were submitted to the DPO Khammam in the fake caste certificate on the signature by the MRO, Chandrugonda vide No.SSID:2225-0000-1016-4703, Appl.No.2008-430, Dt.30.07.2007, as that document was genuine. In District Special Branch, Khammam certificates and antecedents verification found it to be the MRO Chandrugonda signature was forged on the above caste certificate.
Investigate case whether
caste certificate SSID:2225-0000-1016-4703, Appl.No.2008430, Dt.30.07.2007 submitted by the alleged accused was issued by VRO or prepared by the alleged accused himself. Hence, he requested to take action against the concerned accused.
Basing on the contents of the above complaint, a case in Cr.No.92/2016 U/secs.420, 468, 471 IPC dt.22.7.2016 was registered on the file of Chadrugonda Police Station and taken up the investigation into the case.
During the course of investigation, the investigation officer examined the complainant/petitioner and some other witnesses and recorded their detailed statements. As part of investigation into the case, this respondent being the investigation officer, obtained original Caste certificate of the Candidate and Verified the Records of MRO., Office. Obtained Letter from MRO., Chandrugonda about the genuinity of the Certificate. Obtained the Staff details from MRO office., worked at the time of Issue of Certificate, Examined the MRO/VRO., worked at that time.
It is submitted that the investigation is under progress. The investigation is pending for want of the following information:
1) Details of Computer operator worked in 20072008., in MRO office. 2) Full address of the MRO/VRO/Computer operator/Record assist (IN 2007-08) 3) The investigation will be completed., if Police obtains full addresses MRO/VRO/Computer operator/Record Asst.worked in 2007-2008.
It is humbly sumitted that so far 2 letters dated 17.4.2018 and 28.4.2018 were addressed to the Tahsildar, Chandrugonda Mandal requesting him to send following information to enable investigating agency to proceed with further course of action in to the case.
1) who is the Tahsildar from 1.1.2007 to 31.12.2007. Particulars Tahsildar with full name and permanent address and mobile number.
2) Details of VRO, Ganugapadu Panchayat from 1.1.2007 to 31.12.2007. Particulars of the VRO, with full name and address and mobile number.
3) Details of computer operation Sri B.V.Ramarao with permanent address and mobile number.
The reply from the MRO is awaited.
It is pertinent to submit that the averments made in the affidavit are subject matter investigation in Cr,No.92/2016 U/Secs.420, 468, 471 IPC, for which a detailed investigation is under progress. To complete the full fledged investigation into the case, it requires minimum 2 months time to the investigating agency. In obtaining information from the Mandal Revenue Officer, the delay has caused and the delay is neither willful nor wanton, for which, I seek pardon of this Hon'ble court. I assure to the Hon'ble Court that the investigation will be completed as expeditiously as possible and an appropriate report U/sec.173 Cr.P.C will be filed before the concerned Hon'ble Court.
On noticing the above instructions, a request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.
Accordingly, the writ petition is disposed of by placing on record the written instructions dated 26.09.2018 furnished by the Sub-Inspector of Police, Chandrugonda Police Station. There shall be no order as to costs.
Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
