HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.34698 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 5th respondent in denying the registration of the registered document of the petitioner in respect of the property covered under document No.842 of 2007, under the guise of G.O.Ms.No.215 Revenue (Assn-I) Department dated 13.5.2016, and consequential proceedings to an extent of 204.77 sq. yards of constructed house and vacant site of existing house No.1-370, Ram Nagar, Vayalapadu town and Mandal, Chittoor District, without any classification under prohibitory list, as illegal and arbitrary.

Learned Government Pleader for Revenue, placed on record, the written instructions received from the Tahsildar, Valmikipuram, Chittoor District, which discloses that the land in Sy.No.1264-4, admeasuring Ac.0.24 cents, is classified as Patta Dry land and standing in the name of Gannavaram Ramaswamy vide Column No.16 as per the Diaglot Vayalpad Village. It is stated that Sy.No.1264-4 is not included in the prohibited list under Section 22-A of Registration Act. It is further stated that the revenue records have to be rectified by making an appropriate application seeking deletion of the same from the prohibited list.

months from the date of receipt of copy of this order, after giving reasonable opportunity of hearing to the petitioner and all concerned. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
