THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 41157 OF 2016 O R D E R :
Questioning the inaction on the part of the 3rd respondent against the 4th respondent pursuant to the complaint dated 19.11.2016 of the petitioner, this Writ Petition has been filed. The main grievance of the petitioner is that despite an injunction order in his favour, the 4th respondent has been interfering with his property and harassing him. On 28.11.2016, when the matter was taken up for consideration, learned Government Pleader for Home (Telangana) sought time to secure instructions. Today, the learned Government Pleader, based on the written instructions received from the Sub-Inspector of Police, S.R. Nagar Police Station, Hyderabad, would submit that the inquiries revealed that there are civil disputes pending between the petitioner and the 4th respondent and since the complaint of the petitioner is more in the civil nature, he was advised to approach the Court of civil jurisdiction and seek appropriate remedy. The written instructions are taken on record.
In these circumstances and in view of the fact that admittedly there being no allegations against Respondents 1 to 3 of their omissions and commissions and also the fact that the petitioner has already obtained an order of injunction against the 4th respondent with respect to the property, leaving it open to the petitioner to approach the civil Court seeking appropriate remedy
for enforcing the orders passed in the Interlocutory Application, the Writ Petition stands closed. No costs.
Consequently, the miscellaneous applications, if any shall also stand closed.
