ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.393 of 2025 before the Nizamabad IV

Town Police Station, Nizamabad District, registered for the offences punishable under Sections 108 of BNS. 2.

The brief facts of the case are that the complainant reported the death of his elder son Akash, who was found hanging in a rented room at Vinayak Nagar, Nizamabad on 25.10.2025. It was alleged that Akash had been in a relationship with the petitioner Sindhu Aishwarya and that frequent petty disputes had arisen between them. The complainant stated that on the afternoon of the incident, the petitioner and the deceased were last seen together in the room, and later the petitioner informed a third person over phone that Akash had committed suicide but was not present when others reached the spot. Alleging that Akash committed suicide due to the petitioner's harassment, the complainant lodged a report before the Police and the crime was registered for the above said offences.

Heard Sri Nikhil Chainani, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the complaint was false and frivolous and that no ingredients of Section 108 BNS were made out, as there was no allegation of instigation, conspiracy, or intentional aid on the part of the petitioner. He further submitted that mere petty quarrels between two adults in a relationship could not amount to abetment of suicide and that the complaint itself disclosed no overt act attributable to the petitioner. He contended that all material evidence was already collected by the police. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. Further, the investigation was not yet completed. At this stage, granting of pre-arrest bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by the learned counsel on both sides and upon a perusal of the material

available on record, it appears that the offence alleged against the petitioner is under Section 108 of the BNS. The main allegation against the petitioner is that she had instigated the deceased to commit suicide; however, there is no suicide note or any material to substantiate such instigation except for the vague allegation of petty disputes between the petitioner and the deceased. Considering the facts and circumstances of the case, this Court deems it appropriate to grant pre-arrest bail to the petitioner, subject to the following conditions: i.

The petitioner shall surrender before the Station House Officer, Nizamabad IV Town Police Station, Nizamabad District, within two weeks from today, and on such surrender, the said Station House Officer shall release her on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required 7.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
