THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.28495 OF 2012 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus by declaring impugned action of the respondent No. 2 in threatening the petitioner, to settle the issue with the 3rd respondent by paying money on or before 07.09.2012 as illegal, arbitrary and violative of principles of natural justice and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice."
2. Heard Sri M.Jayaram Reddy, learned counsel appearing for the petitioner, learned counsel appearing for the respondents.
3. The counter affidavit is filed by the Inspect of Police, Punjagutta, P.S. Hyderabad and Paragraph 6 of the said affidavit reads as under: "It is pertinent to submit that as of now, no complaint whatsoever is received or registered against the petitioner herein on the file of Punjagutta Police Station. I humbly submit that this respondent never summoned the petitioner to the police station nor asked him to settle the matter with the 3rd respondent as alleged. I humbly submit that the dispute of the petitioner as well as the 3rd respondent is purely civil in nature and hence this respondent police has nothing to do with it. To settle his personal scores with the 3rd respondent, the petitioner made baseless allegations against this respondent which are far from truth. Hence the writ petition is devoid of merits."
4. While referring to the averments in the above Paragraph, it is requested by the learned counsel for the petitioner herein that the writ petition can be closed by recording the averments made in Paragraph No.6 of the counter affidavit filed by the
Inspector of Police, Punjagutta Police Station, Hyderabad.
5. In view of the above submission, writ petition is disposed of, by recording the averments made in Paragraph No.6 of the counter affidavit filed by the Inspector of Police, Punjagutta Police Station, Hyderabad.
