THE HON'BLE SRI JUSTICE DILIP B.BHOSALE CIVIL REVISION PETITION No. 2766 of 2014 P.C:

Heard learned counsel for the parties.

This C.R.P. is against the order, dated 24.06.2014, passed on I.A.No.71 of 2014 in O.S.No.48 of 2014, whereby the respondent's prayer for attachment before judgment has been allowed.

Learned counsel for the petitioners submits that the petitioners are prepared to furnish security and he also filed an affidavit giving the details of the property which they would like to furnish as security. The property offered as security, according to the petitioners, is worth Rs.5 crores. In view thereof, the learned counsel for the parties have agreed for the following order:

"The petitioners shall furnish a security, as aforementioned, covering the entire claim amount, to the satisfaction of the Court below, within a period of six

(6) weeks from today. Till then, the impugned order shall remain stayed with the condition that under any circumstances, the petitioners shall not create any third party rights in the property to be attached under the impugned order. If the security is not furnished within the stipulated time, the impugned order shall become operative. It is further made clear that if the security is furnished to the satisfaction of the Court below, the impugned order shall render ineffective." With these observations, the C.R.P. is disposed of.
