THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 19625 of 2016 ORDER:

The petitioner complains of inaction on the part of the 4th respondent in proceeding with the inquiry with regard to misappropriation of gram panchayat funds to a tune of Rs.1,63,000/- by the Sarpanch of Chaganam Rajupalem Village, Saidapuram Mandal, SPSR Nellore District.

Today, learned Government Pleader for Panchayat Raj (Andhra Pradesh) has produced before this Court the instructions, in writing, received from the Divisional Panchayat Officer (FAC), Gudur, to the following effect:

" ..... The District Panchayat Officer, SPSR Nellore District, in his letter dated 01.07.2015 directed the Divisional Panchayat Officer, Gudur on 09.07.2015 issued a notice and visited the Gram Panchayat on 28.07.2015 and recorded the statements of the villagers, but he did not finalize the report in the matter and later he was transferred to Guntur District. The Divisional Panchayat Officer, Gudur who was posted in the said post also once again issued a notice on 13.01.2016 stating that he will visit the Gram Panchayat on 22.01.2016 to conduct inquiry on the matter. Later due to his illness he went on leave.

It is further submitted that the senior-most Extension Officer (PR & RD) and Resource Person of RGPSA was kept as Full Additional Charge for the post of Divisional Panchayat Officer, Gudur and the present Divisional Panchayat Officer, Gudur on 09.05.2016 and on 04.07.2016 directed the Extension Officer (PR & RD), Sydapuram Mandal, who is also an inspecting officer according to the rules prescribed in G.O.Ms.No. 410, dated 28.12.2011 to conduct inquiry on the allegations made by the Upa-sarpanch and ward members against the Sarpanch, Chaganam Rajupalem Gram Panchayat of Sydapuram Mandal. The report is awaited. After receipt of the report from the Extension Officer (PR & RD), Sydapuram Mandal, a report will be submitted to the District Panchayat Officer, SPSR Nellore District for taking further action in the matter."

In view of the aforesaid instructions, the petitioner cannot be

said to have any grievance against the 4th respondent in the matter of proceeding with the inquiry against the Sarpanch, as complained. Hence, the Writ Petition is closed. No costs. The instructions, in writing, secured by the learned Government Pleader from the Divisional Panchayat Officer (FAC), Gudur are taken on record.

Consequently, the Miscellaneous Applications, if any shall also stand closed.
