THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.13581 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "The Hon'ble Court may be pleased to issue a Writ of Mandamus, or any other appropriate writ, order declaring the action of the 2nd respondent herein in not considering the representation dated 26- 2-2016 wherein the petitioner made request to revoke the order of suspension of license of petitioner's society Toddy shop i.e Toddy Tappers Co-operative Society, Uppal Wan No.1 vide license No. No.226 dated 5-10-2007, as illegal, arbitrary and in violation of Article 14 and 21 of Constitution of India besides principles of natural justice and consequently direct the official respondents to revoke the order of suspension of license of petitioner's society Toddy shop i.e Toddy Tappers Co-operative Society, Uppal Kalan vide license No. No.

226 dated 5-10-2007 by considering the representation dated 26-02-2016 and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case." Sri K. Ravinder Reddy, learned counsel for the petitioner, states that the licence of the petitioner - society was thereafter cancelled but its application dated 26.02.2016, whereby it sought to compound the offence is still pending consideration.

As the petitioner - society's licence had already been subjected to cancellation, which is not even under challenge before this Court, no cause is made out for interference at this stage on that issue. However, as the petitioner - society's representation dated 26.02.2016 is stated to be still pending consideration, the writ petition is disposed of directing the Commissioner, Prohibition and Excise, Telangana, to consider the said representation in accordance with law and take appropriate action thereon. This exercise shall be completed expeditiously and in any event, not later than two weeks from the date of receipt of a copy of this order.
