THE HON'BLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.46489 of 2022 ORDER:

Petitioner is aggrieved by the action of the respondent Nos.2 and 3 in not registering the complaints of the petitioner dated 21.12.2022 and 23.12.2022 against respondent Nos.4 to 13 2.

The learned Assistant Government Pleader for Home, having received written instructions dated 29.12.2022 from the Sub-Inspector of Police, Kothapally Police Station, Karimnagar Commissionerate, submitted that pursuant to the complaints made by the petitioner through post, a G.D. entry was made on 22.12.2022 and respondent No.3 deputed Head Constable No.2050 to the house of petitioner on 22.12.2022 at the given address, but the petitioner was not available. The respondent No.3 conducted preliminary enquiry and it was revealed that the respondent Nos.4 to 13 did not trespass, beat or threaten as alleged by the petitioner. It is further stated that after finalizing enquiry, necessary action will be taken against respondent Nos.4 to 13.

The learned counsel for petitioner pointed out that the Tahsildar, Kothapalli mandal addressed letter to the District Panchayat Officer, Karimnagar district vide proceedings vide Ref.No.B/736/2022 dated .11.2022 stating that tin sheds were constructed by Perumandla Venugopal, Koyyeda Srinivas, Koyyeda Ellaiah, Koyyeda Sampath and Merugu

Srinivas in the Shikam land in Sy.No.142 situated at Chinthakunta village, Kothapalli mandal by encroaching upon Government land. It is further stated that the said persons do not have any patta/possession certificates or any other valid documents and the constructions have been stopped and request was made to the District Panchayat Officer, Karimnagar to cancel the house numbers and permissions issued in favour of the said persons. 4.

In the circumstances, the respondent No.3 is directed to take into consideration the letter of the Tahsildar, Kothapalli mandal vide Ref.No.B/736/2022 dated .11.2022 addressed to the District Panchayat Officer, Karimnagar district and also further documents submitted by the petitioner in support of his claim that there is an encroachment of Government land by unofficial respondents and further consider the request of the petitioner for providing protection to his life and liberty. If the petitioner has any further grievance, he is at liberty to approach this Court at a later point of time.
