HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRL.M.P.NO.5736 OF 2015 AND CRIMINAL PETITION No.5420 OF 2015 COMMON ORDER:

This Criminal Petition is filed by the petitioner/accused under Section 482 Cr.P.C seeking to quash the proceedings in crime No.268 of 2014 of Kukatpally Police Station, Cyberabad, registered for the offence punishable under Sections 306, 342 and 506 I.P.C.

The said crime was registered for death of one Sai Kumar Goud S/o Laxminarayana goud, who committed suicide on 14.04.2014 allegedly for recouping money by him while working under the petitioner herein.

Heard the learned counsel for the petitioner and the learned counsel for respondents.

Pending the Criminal Petition, the de facto complainant filed Crl.MP.No.5736 of 2015 to record the compromise and quash the F.I.R. proceedings.

The mother of the deceased, the de facto complainant, who is brother of the deceased, wife of the deceased and the accused are present before the Court and they identified by their respective counsel and stated that they amicably settled the matter outside the Court to purchase piece and in furtherance of interest of them, since the accused offered to pay Rs.5 lakhs which includes Rs.4 lakhs to the wife and minor son of the deceased and Rs.1 lakh to the mother of the deceased and hence to compound the offence.

On perusal of the material, there is no abatement to

commit suicide by the deceased. But in view of interest of the victims, permission is accorded to compound the offence by invoking Section 482 Cr.P.C. to sub serve the ends of justice. Accordingly, Crl.M.P.No.5736 of 2015 is ordered and the Criminal Petition is allowed by quashing the proceedings in crime No.268 of 2014 of Kukatpally Police Station, Cyberabad.
