THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11387 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/accused seeking grant of anticipatory bail in crime No.369 of 2015 on the file of the V Town Police Station, Nellore, SPSR Nellore District, registered for the offence under Sections 420, 406, 408, 467, 468, 471 IPC.

Heard and perused the material available on record. The allegation against the petitioner herein is that the petitioner, being the Senior Marketing Executive in M/s.Sriram Transport Company, collected huge amounts from various persons and failed to deposit the same in the company's account and further, he also issued 103 fake insurance policies to the persons, from whom he collected amounts.

Learned counsel for the petitioner submits that the petitioner has not committed any offence and he is a law abiding citizen and he is ready and willing to cooperate with the investigating agency and as such, he prays this Court to grant anticipatory bail to the petitioner herein. This Court is of the view that in these types of cases, the arrest and custodial interrogation of the accused is very much necessary and as such, this Court is not inclined to grant anticipatory bail to the petitioner herein.
