HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26130 OF 2017 ORDER:

Heard learned counsel for petitioner and learned standing counsel for respondents 3 and 4.

The petitioner claims to be the absolute owner and possessor of land of an extent of Ac.0.64 cents in Survey No.646/1 of G.C.Palem Village, H/o G.Lingapuram of Bandi Atmakur Mandal, Kurnool District. He states that he raised a cattle shed in an extent of Ac.0.08 cents and the remaining land is being used for raising cattle feed. He has been paying taxes for the cattle shed.

While so, when the fourth respondent issued a notice alleging that the petitioner dumped fifty trips of mud on the public latrine and boring, and caused obstruction to the road, and asked the petitioner to submit the documents in support of his claim, failing which, necessary expenditure will be collected from the petitioner for removing the mud from the road and other public property, the present writ petition is filed by the petitioner apprehending that the cattle shed would be removed in the guise of the present notice. On instructions, learned standing counsel for respondents 3 and 4 submits that no action is being taken for removal of the cattle shed, but the issue relates to the dumping of mud on the public road, public latrine and bore.

In such circumstances, if the mud belongs to the petitioner, the petitioner shall take steps for removal of the mud and if it does not belong to the petitioner, it is open to the respondents 3 and 4 to remove the mud and take appropriate proceedings against the person, who dumped the mud on the public road and property.
