HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No. 14305 of 2013 ORDER:

Heard.

2. It is the submission of the learned Public Prosecutor that the investigation is in progress and to be concluded soon showing the complicity of the petitioner.

3. It is premature to express any opinion, but for giving opportunity, in the event of filing final report and taking cognizance by the Magistrate concerned, to move a fresh application by the petitioner, and while directing the police to complete the investigation and file a final report within two months from the date of receipt of a copy of the order at any cost without seeking any further time, failing which, fresh liberty be given to the petitioner on that ground also. It is needless to say that the petitioner is already enlarged on bail, according to the statement of the counsel for the petitioner, and still he is attending the Court pending investigation.

The learned Magistrate may dispense with his presence, pending investigation, before the Court but for to issue summons in the event of filing of final report and taking cognizance.

4. Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the criminal petition shall stand dismissed.
