THE HONOURABLE MR JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.2868 of 2015

ORDER

Heard learned counsel for the petitioner and learned Standing Counsel for APTRANSCO.

2. To the extent of the grievance of the petitioner in not considering his objections to the final key answers, a letter of Chief General Manager/HRD dated 01.01.2015, is produced. The letter itself says that the petitioner's objections were forwarded to the Coordinator, GET 2014 and the objections were in turn referred to the subject experts. It is also indicated that the experts decided that the answers given in the final key are reasonable and most appropriate and the benefit of ambiguity, if any, is given in favour of the candidates. Hence, no modification in the final key is recommended.

3. In view of the said opinion of the experts, where petitioner's objections are already considered, nothing further survives for consideration in the writ petition. As the objections of the petitioner have already been considered by the experts and the subjective satisfaction of the experts is already communicated to the petitioner and since the subject matter relates to academic questions, this Court cannot substitute its opinion even if it accepts the petitioner's answers are correct. Hence, no further relief can be granted to the petitioner.

4. The Writ Petition is accordingly dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
