THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 9151 of 2011 ORDER:- The present writ petition is filed, under Article 226 of the Constitution of India, seeking a direction to the respondents to conduct a survey of the entire land in Survey No.287/5C of Elamandyam village, Renigunta Mandal, Chittoor District, and divide the land of the petitioner admeasuring Ac.0.64 cents from the total extent of Ac.1.04 cents in the said survey number and fix boundaries to the land.

At the time when the matter is taken up for hearing, the learned Government Pleader for Revenue, appearing for the respondents, on instructions received from the 1st respondent, submits that basing on a representation dated 07.07.2010 made by the petitioner, the Mandal Surveyor, Renigunta (2nd respondent), visited the land in Survey No.287/5C on 24.08.2010 and measured the entire extent of Ac.1.04 cents in the presence of the petitioner's father. The 2nd respondent also recorded the statement of the petitioner's father. It has been found that there are no sub-divisions in the said survey number and, thus, it is not possible to fix the boundaries for the land of the petitioner. Subsequently, the 1st respondent also inspected the land on 18.07.2014 along with the 2nd respondent and the Revenue Officer concerned and found that there are no subdivisions. As per the FMB pertaining to S.No.287/5C, there are temporary sub-divisions in the adangal as S.No.287/5C1. It

was found that land to an extent of Ac.0.64 cents stands in the name of the petitioner and the remaining extent of Ac.0.40 cents, which is denoted as S.No.287/5C2, stands in the name of one A. Chengaiah. The entire extent of Ac.1.04 cents in S.No.287/5C is vacant without any cultivation and enjoyment since long back and even there are no ridges on ground to identify the land to an extent of Ac.0.64 cents purchased by the petitioner for fixing boundaries.

In view of the submission of the learned Government Pleader for Revenue, no further orders need be passed in the writ petition.

Accordingly, the Writ Petition is closed leaving it open to the writ petitioner to avail the remedies, if any, available under law. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
