THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34713 of 2018 ORDER:

The grievance of the petitioner in the present Writ Petition is without being preceded by any show cause notice and without giving any opportunity to the petitioner, the impugned notice came to be issued by the respondent-Municipality asking the petitioner to remove the constructions.

On the other hand, it is submitted by Sri Nimmagadda Venkateshwarlu, learned Standing Counsel for the respondentMunicipality, that the impugned notice can be treated as a show cause notice and liberty may be given to the petitioner to submit explanation to arrive at an appropriate decision by the respondentMunicipality. Recording the said submission, the Writ Petition is disposed of, directing the impugned notice to be treated as a show cause notice with a liberty to the petitioner to file an appropriate explanation within a period of two weeks from the date of receipt of a copy of this Order and with a further direction to the respondents to consider the same and pass appropriate orders, or, take appropriate action, strictly in accordance with law. Till the said exercise attains finality, no coercive action against the subject constructions. There shall be no order as to costs. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
