HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.16272 of 2017 ORDER:

Heard Ms.S.Nanda for petitioners and the Assistant Government Pleader for Assignment.

The petitioners complain against inaction of respondents in granting house site pattas to petitioners, pursuant to the recommendations made through proceedings Ref.No.B/ 177/ 2014, dated 18.02.2014, Ref.No.B/ 177/ 2014, dated 26.02.2014, Ref.No.DT(2)/ 1037/ 2014, dated 24.02.2014 and Ref.No.

DT(2)/ 1037/ 2014 dated 04.06.2015.

The 4th respondent filed counter affidavit and the 4th respondent does not dispute the averments made by petitioners or the proceedings on which the petitioners are relying on. The 4th respondent in addition to the counter affidavit places on record letter dated 01.05.2018 addressed to the office of learned Government Pleader (Revenue) accepting to give pattas within a reasonable period. The operative portion of letter dated 01.05.2018 reads as follows :- " I invite kind attention to the reference cited, it is submitted that a Message has been received from Legal Cell Kadapa that the G.P. for (Revenue) High Court of AP, Hyderabad, has called for report from District Collector, Kadapa for assigning of house site pattas to the petitioners in W.P.No.16272 of 2017. It is submitted that the petitioners will be granted house site pattas in Sy.No.1128/ 3 of N.Mydukur village within 3 months after

getting approval of the District Collector, Kadapa (in place of 62 ineligible house site pattas identified during 5th phase J.B.Programma surrendered to Collectorate).

Hence, in this Survey Number vacant place is available and suitable for house site pattas distribution.

This is submitted for favour of kind information." By accepting the statement made by the 4th respondent, the writ petition is disposed of.

The 4th respondent is further directed to expedite the process of securing approval from the District Collector, if circumstances so warrant, by enclosing a copy of the order in the present writ petition. The 4th respondent, as undertaken by him, issues house site pattas to petitioners.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
