THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.256 of 2015 ORDER:

This civil revision petition is filed under Section 115 of the Civil Procedure Code challenging the orders dated 26.09.2014 in E.A.No.40 of 2014 in E.P.No.105 of 2006 in O.S.No.143 of 1997 on the file of the Court of Junior Civil Judge, Allagadda, Kurnool District. Heard the learned counsel for the revision petitioner. In spite of service of notice, none appeared on behalf of the respondents. The trial Court stayed the execution proceedings in view of pendency of O.S.No.62 of 2014 on the file of the Junior Civil Judge, Allagadda. Learned counsel for the petitioner in all fairness submits that the parties in E.P.No.105 of 2006 and O.S.No.62 of 2014 are one and the same. The trial Court stayed the E.P. on the sole ground that O.S.No.62 of 2014 is pending.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the trial Court to dispose of O.S.No.62 of 2014.

Having regard to the facts and circumstances of the case and also in view of the submissions made by the learned counsel for the petitioner, the learned Junior Civil Judge, Allagadda is hereby directed to dispose of O.S.No.62 of 2014 as expeditiously as possible, preferably, within a period of six months from the date of receipt of copy of this order.

With the above direction, the civil revision petition is disposed of. As a sequel, the miscellaneous petitions, pending if any, shall stand closed.
