HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.38636 of 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking to declare the inaction of the respondents in re-assigning the land admeasuring Ac.0-30 1⁄4 Gts. in survey No.626, Miryalaguda Revenue Village & Mandal, Nalgonda District, in favour of the petitioner, as illegal and arbitrary.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the admission stage itself.
Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the authorities to consider his representation dated 12.09.2016 for re-assignment of the subject land. Learned AGP would submit that the 3rd respondent may be directed to dispose of the representation of the petitioner, if the same is still pending consideration, in accordance with law. Having regard to the rival submissions made and taking into consideration the history of the case, the Writ Petition is disposed of directing the 3rd respondent to deal with the representation made by the petitioner on 12.09.2016, in accordance with law, and pass necessary orders thereon after hearing the petitioner and other aggrieved persons, if any, as early as possible, preferably
within a period of 4-6 weeks from the date of receipt of a copy of this order.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. No order as to costs.
