THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.21391 OF 2016 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed seeking a writ of Mandamus to declare the action of the respondents in not approving or rejecting the petitioner's plan applied vide RC No.0237/ 2016/ G1, as illegal and arbitrary, and consequently, direct the respondents to take appropriate decision on the building permission application of the petitioner.

Heard and perused the material available on record. It is the specific contention of the learned counsel for the petitioner that the petitioner has re-submitted the application to the 3rd respondent as far back as on 12.02.2016 for grant of building construction permission by complying with all the queries raised by the 3rd respondent. But, the 3rd respondent has not passed any orders so far, either approving or rejecting the application of the petitioner, and hence, he requested to direct the respondents to pass orders on the application of the petitioner.

Considering the limited grievance of the petitioner, the writ petition can be disposed of with a direction to the 3rd respondent to pass appropriate orders on the application made by the petitioner, within a specific time.

Accordingly, the Writ Petition is disposed of directing the 3rd respondent to pass orders on the application for grant of building construction permission, resubmitted by the petitioner on 12.02.2016, within a period of eight (8) weeks from the date of receipt of a copy of this order.

No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
