THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.34346 OF 2013 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader appearing for the respondents 1 to 5.

The prayer sought for in the writ petition is as under: " to issue a writ order or direction more particularly in the nature of writ of mandamus directing the respondents 1 to 5 herein to take action against the 6th respondent herein according to law by processing with the criminal cases registered against him by the Sydapuram P S." The grievance of the petitioner herein is that in spite of giving a complaint on 01.08.2013, the respondents-police are not taking any action against the 6th respondent in accordance with law. During the course of hearing, the learned Government Pleader placed on record the written instructions dated 23.12.2013 issued by the Sub Divisional Police Officer, Gudur Division. The same is made part of the record.

A perusal of the said written instructions would reveal that pursuant to the complaint lodged by the petitioner, Crime No.126 of 2013 has been registered for the offences under Sections 352, 448, 290, 506 I.P.C. and under Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 on 05.08.2013. During the course of investigation, the role of 6th respondent was not established and accordingly, his name has been deleted from the array of accused and a charge sheet was filed on 20.12.2013.

In view of the above, this Court is of the opinion that no further orders are required in the writ petition.

Accordingly, the writ petition is dismissed. No costs. Pending miscellaneous petitions, if any, shall stand closed. ___________________ P.KESHAVA RAO,J 23rd NOVEMBER 2018.
