HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.34551 of 2018 ORDER:
1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the Writ Petition is disposed of at the admission stage itself.
2) The present Writ Petition came to be filed declaring the action of respondents in trying to interfere with the construction work, which is being carried out by the petitioner, as per the sanctioned plan vide permit No.3/C19/00022/2018, dated 02.01.2018, issued by the Greater Hyderabad Municipal Corporation, Hyderabad, in respect of the premises bearing municipal No.8-1-299/75, admeasuring 201 square yards, situated at Al-Hamra Colony, Shaikpet village and mandal, Hyderabad, without following due process of law.
3) Learned counsel for the petitioner would submit that though the petitioner has the sanctioned plan, the respondents are trying to interfere with the possession and enjoyment of the petitioner over the subject land. 4) On the other hand, learned Government Pleader would submit that the said land is a ceiling surplus land, but
however, pleads that any action taken would be in accordance with law.
5) Having regard to the above, the Writ Petition is disposed of directing the respondents not to interfere with the possession and enjoyment of the petitioners over the subject land, except in accordance with law.
