The grievance of the petitioners in this case was as to the alleged inaction of the police authorities upon their complaints dated 16.04.2010 and 21.02.2011. 2 . The Inspector of Police, Kancharapalem Police Station, Visakhapatnam, the fourth respondent, filed a counter affidavit stating that pursuant to the petitioners'
complaints, Crime No.124 of 2011 was registered on the file of Kancharapalem Police Station, Visakhapatnam, under Sections 447 and 506 I.P.C and investigation was taken up. Upon examining nine witnesses, it was found that the matter was essentially in the nature of civil dispute, which was already pending consideration before the competent Civil Court. The allegations of trespass and threat were found to be false and accordingly, after obtaining permission from the Assistant Commissioner of Police, North Sub Division, Visakhapatnam, the case was reported as 'false' before the concerned Court on 30.04.2011.
3. In the light of the aforestated facts, it is manifest that the police authorities cannot be accused of inaction on the petitioners' complaints. Suitable timely action in accordance with law was taken by them. In the event the petitioners are aggrieved in connection therewith, it is for them to avail appropriate remedies in accordance with law.
4 . The Writ Petition is therefore dismissed with the liberty aforestated. Pending Miscellaneous Petitions, if any, shall stand closed. No order as to costs. _______________ SANJAY KUMAR, J Date: 02.06.2015 va
