ORAL ORDER:

This Court disposed of writ petition No. 34072 of 2015 by order dated 14.10.2015 directing the respondents 2 to 4 to consider the representations of petitioner dated 20.3.2015, 4.4.2015 and reminder dated 13.7.2015 and after affording opportunity to 5th respondent pass appropriate orders within six weeks. Alleging disobedience of the said orders, this contempt case is filed. 2.

Counter affidavit is filed deposed by Mr. M Mahender, Assistant City Planner. According to the averments made in paragraph 4, a decision was already taken and speaking order dated 23.4.2016 was communicated to the petitioner through registered post. Learned standing counsel produced original copy of the decision taken on 23.4.2016.

Learned counsel for petitioner sought to contend that copy of order dated 23.4.2016 is not served on him. Learned standing counsel furnished a copy of the said order.

Since direction was only to pass orders on representations of petitioner and as decision is already taken, it cannot be said that there is disobedience of the orders of this Court. There is delay in taking a decision as against the time fixed by this Court and in paragraph 4, official respondents seek apology of the Court for not passing orders within the time fixed. Such apology is accepted and contempt case is closed. No costs.
