THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.20492 OF 2016 ORDER:
This Writ Petition is filed with the prayer, which reads as under:
"To issue an appropriate writ or order or direction more particularly a writ in the nature of Writ of Mandamus action of the respondent No. 2 to 4 in not taking action against bore wells sunk by the respondent No. 5 and 6 in Sy.No. 717 and Sy.No. 618 without obtaining permission under provisions of Water, Land and Trees Act, 2002 (in short WALTA) and which is within 100 meters radius from public drinking water source as illegal, arbitrary, highhanded and violative of Article 14 of Constitution of India apart from being violative of provisions of WALTA and consequently direct the respondent No. 2 to 4 to take action against the illegal bore wells sunk by respondent No. 5 and 6."
Now the learned Assistant Government Pleader for Revenue, on written instructions, submits that Gram Panchayat has passed a resolution on 22.07.2015 to undertake the bore-well of respondent No.5 to overcome the prevailing water scarcity in the Village and pursuant to the same, the subject bore-well is being used for public purpose for supplying drinking water to the villagers. Recording the same, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs.
