This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS) by the petitioner, who is arrayed as accused No.1 in the event of his arrest in connection with FIR No.312 of 2025 of Nacharam Police Station, Rachakonda Commissionerate,

Medchal-Malkajgiri District, registered for offences punishable under Sections 318(4), 336(3), 340(2), 338 r/w 3(5) of the BNS.

The brief facts of the case are that, on 22.05.2025, the de-facto-complainant lodged a report before the police stating that there is an agreement between the de-facto complainant and this petitioner for supply of Zinc Raw Material and the MOU was entered between the parties on 01.08.2019 and the petitioner herein along with accused No.2 hatched a plan to grab the property and intentionally created forged document in their favour vide Document No.6347 of 2008, dated 06.08.2008 and later, to cause loss to the de-facto complainant, the same was forged by creating a third party right. Basing on the said complaint, the police registered a case for the above said offences.

Heard Sri K. Narsimha Reddy, learned counsel for the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent- State.

The contention of the petitioner is that the petitioner is innocent of the said allegations and all the allegations leveled against him are nothing but false and already the de-facto complainant filed a case in NCLT and he was already declared as insolvent and a suit is also filed by the de-facto complainant for the same and he filed the present false case only to pressurize the petitioner and none of the alleged offences are attracted to the petitioner herein and he is ready to cooperate with the investigation. Therefore, he prayed the Court to grant anticipatory bail to the petitioner. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature and custodial interrogation of the petitioner is required and prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that whatever the allegations made against the petitioner are that the document of the year 2008 was forged by the petitioner. Even according to the de-facto

complainant, the land pertains to the petitioner and the same was forged and created third party right and the investigation is only on the documentary evidence and the custodial interrogation of the petitioner is not required. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner/accused No.1, subject to the following conditions:

i.

The petitioner/accused No.1 shall surrender before the Station House Officer, Nacharam Police Station, Medchal-Malkajgiri District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioner/accused No.1 shall abide by other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with

Investigating Officer in investigating the case.

iii.

The petitioner/accused No.1 shall appear before concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
