HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.3615 of 2016 ORDER:
The petitioner was given notice of retirement on 02.01.2016, informing him that he is attaining the age of superannuation and shall retire from service on 31.03.2016. Challenging the same, this writ petition is filed.
2. This writ petition is filed apprehending that he is not going to be paid pension and retirement benefits. No reasons are assigned for such apprehension. If the petitioner is in pensionable establishment and he has no impediment, ordinarily a person retiring from service is entitled to settlement of all retirement benefits and payment of pension after retirement. It is only the apprehension of the petitioner that the respondent-employer may not pay the pension and retirement benefits. Thus, claim is premature. The grievance of the petitioner would arise only if such benefits are not paid after his retirement. Therefore, no relief as sought for can be granted.
However, having regard to the fact that petitioner is apprehending that the employer is not going to settle his retirement benefits on the ground that earlier such benefits were not paid to other employees, petitioner is granted liberty to make a representation to the competent authority and as and when such representation is made, the same shall be considered and appropriate decision be taken and communicated to the petitioner within a period of two (2) weeks from the date of submission of such representation.

3. With the above observations the writ petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
