THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.3343 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/ accused in C.C.No.276 of 2014 on the file of XIV Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, arising out of private complaint filed under Section 200 Cr.P.C. for the offence punishable under Section 138 of the Negotiable Instruments Act. Heard and perused the material on record.

After arguing for some time, the learned counsel for the petitioner, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner before the trial Court.

In any event, considering the facts and circumstances of the case, the presence of the petitioner/accused before the trial Court is dispensed with except on the dates when his presence is specifically required for the purpose of examination under Section 313 Cr.P.C. or for any other purpose and the petitioner shall be properly represented by his counsel.

Accordingly, the criminal petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending, shall stand closed.
