HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.716 of 2018 along with I.A.No.1/2018 in CRP No.4405/2017 Order:

Both revisions are between the same parties. C.R.P. No.4405 of 2017 was already disposed of by a common order passed on 22-12-2017, allowing the prayer therein. But while doing so, a direction was issued to the First Appellate Court to dispose of the appeal A.S.No.45 of 2015 within six weeks.

2. It is contended that the Principal District Court, Krishna has already passed an order in Transfer O.P.No.1 of 2016 directing the withdrawal of three other connected suits and the transfer of the same to the same Court where the appeal is pending for joint disposal. Therefore, in order to synchronise the pre-existing order of the Principal District Court dated 01-4-2016 with the order passed by this Court in C.R.P.No.4405 of 2017, the petitioner has come up - (a) I.A.No.1 of 2018 for clarifying the order passed by this Court and (b) a civil revision in C.R.P.No.716 of 2018 challenging the order passed in Transfer O.P. No.1 of 2016.

3. Heard Mr. S.Satyanarayana Prasad, learned Senior Counsel appearing for the petitioner and Mr. A.P. Venugopal, learned counsel appearing for the respondent.

4. It is stated by Mr. A.P. Venugopal, learned counsel appearing for the landlord, that all the three suits viz., O.S.Nos.130 of 2011, 233 of 2015 and 491 of 2015, have all

become infructuous, that memos have already been filed and that therefore nothing remains to be adjudicated. In other words, the only lis now pending is A.S.No.45 of 2015.

5. Therefore, C.R.P.No.716 of 2018 and I.A.No.1 of 2018 in C.R.P.No.4405 of 2017 are disposed of directing the First Appellate Court to dispose of A.S.No.45 of 2015 independently. The miscellaneous petitions, if any, pending in the revision shall stand closed. No costs.
