HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.24081 of 2017 ORDER:

Heard Mr. P. L. Rao for petitioners and the Assistant Government Pleader (Assignment) for respondents.

2. The petitioners complain against threatened action of respondents in dispossessing the petitioners from their lawful possession of lands in Sy.Nos.431/ 4, 431/ 6, 453/ 19, 433b, 423/ 3c, 423/ 3b, 441/ 4 and 441/ 3, admeasuring Acs.2.00, 2.00, 2.00, 2.00, 2.00, 2.20, 2.00 and 2.50 cents, respectively, situated at Panduru Village, Kotavuratia Mandal, Visakhapatnam District, without recourse to law, as illegal and unconstitutional.

3. The Assistant Government Pleader by reference to written instructions dated 24.07.2017, which are taken on file, submits that the subject matter of the writ petition is assigned land, the 4th respondent, having noticed the breach of assignment conditions and also provisions of the Act 9 of 1977, has issued notices in Form Nos.I & II and is proceeding in the matter, in accordance with law. The possession of petitioners, if is found to be objectionable, contrary to either assignment conditions or Act 9 of 1977, steps are taken and petitioners dispossessed in accordance with law. The statement is placed on record.

4. The writ petition is accordingly disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
