THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5963 of 2012 ORDER:

Alleging that the police authorities were harassing him in the guise of investigating Crime No.94 of 2012 on the fie of Nallapadu Police Station, Guntur District, the petitioner filed this case and sought entrustment of the investigation in the said crime to the C.B.C.I.D., or any other agency.

By interim order dated 05.03.2012, this Court permitted the police authorities to proceed with the investigation but directed them not to arrest the petitioner pending further orders. Relying on the written instructions dated 17.08.2015 received from the Sub-Inspector of Police, Nallapadu Police Station, Guntur District, the learned Assistant Government Pleader for Home informed this Court that upon the complaint lodged by the 6th respondent against the petitioner, Crime No.94 of 2012 was registered under Sections 323 and 354 I.P.C., read with Section 34 I.P.C., and Section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, on the file of Nallapadu Police Station, Guntur District.

After thorough investigation, it was stated that the police authorities opined that no case was made out for further action and accordingly a final report was filed under Section 173 Cr.P.C., referring the case as 'False'. Notice to that effect was stated to have been given to the complainant, the 6th respondent, on 22.11.2013. In the light of the aforestated developments, the cause for grievance in this writ petition no longer survives for consideration. The writ petition is accordingly closed.

Pending Miscellaneous Petitions, if any, shall also stand

closed. No order as to costs.
