This writ petition is filed by a Sarpanch of the village claiming agreement in her favour for execution of the work of desilting of the small tank of Balasamudram Village in Venkatagiri Mandal and

desilting of the Chinthala Cheruvu Kandriga, pursuant to the resolution passed by the fifth respondent-Paravolu Gram Panchayat on 09.07.2015 allotting the said work to the petitioner. She challenges the entrustment of said work to other persons. A counter affidavit is filed by the fourth respondent-Deputy Executive Engineer, Venkatagiri stating that though resolution Nos.4 & 5 were received from the petitioner, another resolution for the said work was received from the Mandal Parishath Development Officer (MPDO), Venkatagiri. In those circumstances, a letter was addressed to the MPDO, Venkatagiri on 29.07.2015 seeking clarification. After receiving clarification on 03.08.2015, two works were entrusted to one T. Ramachandraiah. It is also stated that the MPDO convened Janmabhoomi Maavooru Committee meeting for the fifth respondentGram Panchayat with seven members and the resolution was also passed with the signatures of four members.

When this Court asked the learned counsel for the petitioner under what Government Order the petitioner can claim the entrustment of work as the petitioner is an individual as against the decision of Janmabhoomi Maavooru Committee, which is supposed to execute the work under its supervision, the learned counsel for the petitioner could not show any Government Order.

In the circumstances, no writ can be issued in favour of the petitioner and therefore, the writ petition is liable to be dismissed and is accordingly dismissed. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
