THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17043 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ, order or direction more particularly, one in the nature of writ of mandamus to declare the action of respondent No.2 in abnormally delaying to release the regular trade license/TIN number after issuing Provisional Trade License on 05.11.2016 to the petitioner to run Sri Venkateshwara Parking Stand as illegal and arbitrary and consequently, direct respondent No.2 to consider the representation, dated 05.05.2017, of the petitioner and release the regular trade license.

Case of the petitioner is that he was allotted open place admeasuring 2800 sq.yds at 17-2-581, Madannapet Market, Saidabad, Hyderabad for the purpose of running parking stand. He paid an advance amount of Rs.50,000/- to Sri Dayanand Vegetable Market Society and is paying rent of Rs.5,000/- per month. He spent Rs.2,00,000/- for the purpose of cleaning the parking area, laying pipelines for provision to rain water, laying parking sheds etc., besides monthly rent being paid for the past eight months. Respondent No.2 issued provisional trade licence vide letter, dated 05.11.2016. Thereafter, the petitioner submitted all the required documents to respondent No.2 for the purpose of obtaining regular trade licence/TIN number. Though the petitioner is having provisional trade license, respondent No.3 is not allowing him to run the business and asking him to produce TIN number.

Hence, he made a representation, dated 05.05.2017, to respondent No.2 to that effect, but the same is not disposed of till date. Hence, he filed the present writ petition.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case and the grievance of the petitioner, respondent No.2 is hereby directed to consider the representation, dated 05.05.2017, of the petitioner and pass appropriate orders in accordance with law as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
