HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3818 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/ accused Nos.1 to 5 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.181 of 2014 of Yemmiganur Town Police Station, Kurnool District registered for the offences punishable under Sections 323, 354 (b), 506 and 509 r/w 34 IPC.

2) Heard learned counsel for the petitioners/ accused Nos.1 to 5 and learned public prosecutor for 1st respondent-state before admission and before ordering any notice to 2nd respondent-de facto complainant.

3) A perusal of the material on record shows falls short to admit the application filed under Section 482 Cr.P.C but for to observe the petitioners have already obtained bail and there is no necessity for the trial Court to direct them to appear for every adjournment pending investigation till filing of charge sheet.

4) Accordingly, the Criminal Petition is disposed of, by directing the trial Court to dispense with their presence pending investigation, so that after filing of final report and if taken cognizance to issue summons for their appearance.

5) As a sequel, miscellaneous petitions, if any filed in this Criminal Petition, shall stand closed.
