HON'BLE SRI JUSTICE J. SREENIVAS RAO WRIT PETITION No.46567 OF 2022 ORDER:

This writ petition is filed seeking a writ of Mandamus declaring the action of the respondent No.2 in not granting stay of operation of order vide Case No.A/35/ LTR/WZD/2022, dated 27.09.2022 passed by respondent No.3 during the pendency of C.M.A. No.7 of 2022 as illegal, arbitrary and violative of articles of 14, 21 and 300-A of Constitution of India besides violative of principles of natural justice and consequently direct the respondent No.2 to grant stay of operation of the said order passed by the respondent No.3 pending disposal of CMA No.7 of 2022.

Heard Sri Krishna Kishore Kovvuri, learned counsel for the petitioner, learned Assistant Government Pleader for Social Welfare appearing on behalf of respondent Nos.1 to 4 and Sri Ajay Kumar Madisetty, learned counsel appearing on behalf of respondent No.5.

Learned counsel for the petitioner as well as learned counsel appearing on behalf of respondent No.5 submits that without going into the merits of the case the writ

petition may be disposed of directing the respondent No.2 to dispose of the appeal CMA No.7 of 2022 filed by the petitioner by fixing time limit and till such time the parties may be directed to maintain status quo in respect of subject property.

In view of the submissions made by the respective parties writ petition is disposed of directing the respondent No.2 to dispose of the appeal in CMA No.7 of 2022 after giving opportunity to the parties in accordance with law within a period of three (3) months from the date of receipt of copy of this order. Till such time, both the parties are directed to maintain Status Quo.

Accordingly, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
