SMT JUSTICE T.RAJANI CRIMINAL PETITION No.10211 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.2, in C.O.R. No.1 of 2018 on the file of the Station House Officer, Mahabubabad Prohibition and Excise Station, Mahabubabad District.

The offences alleged are under Section 8(c) R/w.20 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the Act'), Section 34(e) of the A.P. Excise Act, 1968, and Section 7(a) R/w.8(e) of the A.P. Prohibition Act, 1995.

Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the respondent-State and perused the record. 4.

Learned counsel for the petitioner submits that the petitioner is innocent and he is only a labourer and that it is only based on the confession of A-1 the petitioner was arrayed as A-2.

Learned Public Prosecutor opposed the bail application contending that, as per the contents of the remand report, when the Police enquired the local people with regard to the Auto, they came to understand that two persons came there in the Auto and the confession of A-1, who was driver, reveals that the petitioner herein is also involved in the offence along with A-1. 6.

Hence, the facts of the case do not warrant grant of anticipatory bail to the petitioner/A-2. Accordingly, the Criminal Petition is dismissed. 7.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
