HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.1793 of 2017 ORDER:

The case of the petitioner is that he is the absolute owner and possessor of the land in Sy.Nos 41-E/2A/1, 1691-1, 1691-2A, 1692-1A, 1741-7A, 49/5, 1695-2B, 1747-3, 1748-1, 1784-4, 1748-4, 1749-13, 1749-15, 1716-17B, 1854-3, 1787/1 and 1785/B-1 admeasuring Ac.0-62, 0.02, 1.00, 0.31, 0.07, 0.81, 1.31, 0.02, 0.08, 0.07, 0.08, 0.03, 0.01, 0.04, 0.04, and 0.82 and 1.00 cents respectively situated at Kothapalem Village, Kota Mandal, SPSR Nellore District having succeeded the same from his father and he has been in possession and enjoyment over the said land and his father died on 24-12-1994. On 13-12-2016, the petitioner submitted application to issue pattadar passbooks and title deeds in respect of above said lands. But, no action has been taken by the concerned Tahsildar. On 14-12-2016, the petitioner made representation to the respondents not to entertain any document for the registration in respect of the subject lands. As no orders are passed, aggrieved by the same the present writ petition is filed.

This Court cannot direct the respondents 2 and 3 to go into the title of the petitioner. It is the case of the petitioner that there is threat of alienation of subject

lands. If he has such apprehension, he can approach the civil Court and obtain injunction.

In view of the same, since the petitioner has alternative remedy of approaching civil Court, this Court is not inclined to entertain the writ petition.

Accordingly, this writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 19-01-2017 nvl
